Pursuant to section 4 of the Private Savings Banks (Transfer of Undertakings) Act 1992, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and on the advice of the Minister of Finance given in accordance with a recommendation of the Reserve Bank of New Zealand, hereby makes the following order.

Order

1 Title

This order may be cited as the A.N.Z. Savings Bank (New Zealand) Limited (Transfer of Undertaking) Order 1993.

2 Interpretation

Terms and expressions used in this order have the same meanings as they have in the Private Savings Banks (Transfer of Undertakings) Act 1992.

3 Transfer of undertaking of A.N.Z. Savings Bank (New Zealand) Limited to ANZ Banking Group (New Zealand) Limited

31 August 1993 is hereby appointed as the date on which the undertaking of A.N.Z. Savings Bank (New Zealand) Limited shall vest in its successor ANZ Banking Group (New Zealand) Limited.

4 Dissolution of A.N.Z. Savings Bank (New Zealand) Limited

A.N.Z. Savings Bank (New Zealand) Limited shall be deemed to be dissolved on 31 August 1993.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which is made pursuant to the Private Savings Banks (Transfer of Undertakings) Act 1992, vests the undertaking of A.N.Z. Savings Bank (New Zealand) Limited in its successor, ANZ Banking Group (New Zealand) Limited on 31 August 1993.

The order also declares that A.N.Z. Savings Bank (New Zealand) Limited shall be deemed to be dissolved on that date.

The effect of the order is to transfer the property, rights, and liabilities of A.N.Z. Savings Bank (New Zealand) Limited to ANZ Banking Group (New Zealand) Limited on 31 August 1993 and to dissolve A.N.Z. Savings Bank (New Zealand) Limited on that date.

1 General

This is a consolidation of the A.N.Z. Savings Bank (New Zealand) Limited (Transfer of Undertaking) Order 1993 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
