Agricultural Pests (Exemption of Domestic Rabbits) Order 1994: revoked, on 6 November 2008, by clause 3 of the Regulations Revocation Order 2008 (SR 2008/367).

PURSUANT to section 3A of the Agricultural Pests Destruction Act 1967, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
1 Title and commencement

(1) This order may be cited as the Agricultural Pests (Exemption of Domestic Rabbits) Order 1994.
(2) This order shall come into force on the 28th day after the date of its notification in the Gazette.
2 Certain rabbits exempted

(1) Subject to the conditions specified in subclause (2) of this clause, all rabbits of the following descriptions are hereby exempted from the provisions of the Agricultural Pests Destruction Act 1967:
(a) Rabbits of any of the breeds specified in the Schedule to this order:
(b) Rabbits that are a cross of any of those breeds with any other of those breeds.
(2) The exemption of a rabbit under subclause (1) of this clause is subject to the following conditions:
(a) It shall at all times be securely housed or restrained in a manner that prevents its escape:
(b) It shall not be kept in a manner that allows it to range freely, or graze pasture.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force 28 days after notification in the Gazette, is made under section 3A of the Agricultural Pests Destruction Act 1967 (which, although repealed by the Biosecurity Act 1993, continues to apply to pests until a pest management strategy for them comes into effect under that Act). The order exempts 14 breeds of domestic rabbit (and crosses between any of those breeds) from the application of the Agricultural Pests Destruction Act 1967.
Eleven of those breeds were exempted under earlier orders that were revoked by the Biosecurity Act 1993, but 3 other breeds are also exempted. These are the Giant Chinchilla, the Dwarf Lop, and the French Lop.
