Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings into force, on 1 January 1995, the Fair Trading Amendment Act 1994. The Act repeals section 26 of the principal Act and substitutes a new section 26. The existing section provides that goods that bear a false trade description or a false trade mark are prohibited imports for the purposes of the Customs Act 1966. The new section applies only to goods that bear a false trade description. The new sections 54A to 54M of the Trade Marks Act 1953 (enacted by the Trade Marks Amendment Act 1994) provide for the detention, forfeiture, and disposal of goods bearing infringing trade marks.
