Ozone Layer Protection Amendment Regulations 1997

These regulations are administered in the Ministry for the Environment.

PURSUANT to Part III of the Ozone Layer Protection Act 1996, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and on the recommendation of the Minister for the Environment whose recommendation has been made—

  • (a) After consultation by that Minister in accordance with section 17 of that Act; and

  • (b) After being satisfied that, after making the regulations, New Zealand will be able to give effect to its obligations under the Convention and the Protocol,—

makes the following regulations.

1 Title and commencement

  • (1) These regulations may be cited as the Ozone Layer Protection Amendment Regulations 1997, and are part of the Ozone Layer Protection Regulations 19961 (“the principal regulations”).

    (2) These regulations come into force on 1 January 1998.

2 Base year permits for methyl bromide

  • Regulation 6(3) of the principal regulations is amended by adding, to the reduction timetable, the following:

    1 January 1998 to 31 December 1998 25
    1 January 1999 to 31 December 1999 35
    1 January 2000 to 31 December 2000 45
    1 January 2001 to 31 December 2002 60
    1 January 2003 to 31 December 2004 75
    1 January 2005 100

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 January 1998, set a reduction timetable for methyl bromide for 1 January 1998 onwards. The effect is that base year import permits for methyl bromide will continue to be calculated on the applicant's 1991 consumption of methyl bromide, but will be reduced in accordance with the new reduction timetable. The rules relating to quarantine and pre-shipment permits are unaffected.
