Sheriffs' Fees Amendment Regulations 1997

Sheriffs' Fees Amendment Regulations 1997: revoked, on 1 July 2011, by regulation 5 of the Sheriffs' Fees Amendment Regulations 2011 (SR 2011/171).

These regulations are administered in the Department for Courts.
PURSUANT to section 100A of the Judicature Act 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following regulations.
1 Title and commencement

(1) These regulations may be cited as the Sheriffs' Fees Amendment Regulations 1997, and are part of the Sheriffs' Fees Regulations 19881 (
“the principal regulations”
).(2) These regulations come into force on 1 January 1998.
2 Fee for warrant increased
The Schedule of the principal regulations is amended by omitting from clause 1 the expression
“$830”
(as substituted by regulation 2 of the Sheriffs' Fees Regulations 1988, Amendment No 3), and substituting the expression“$920”
.
3 Revocation
The Sheriffs' Fees Regulations 1988, Amendment No 32 are consequentially revoked.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 January 1998, increase from $830 to $920 the fee payable under the Sheriffs' Fees Regulations 1988 for a warrant on a writ of sale, writ of arrest, attachment, or other process.
The fee is inclusive of goods and services tax.
