PURSUANT to section 87(2) of the Biosecurity Act 1993, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, makes the following order.

1 Title and commencement
-
(1) This order may be cited as the Biosecurity (Wellington Regional Plant Pest Management Strategy) Crown Obligations Order 1998.
(2) This order comes into force on 10 July 1998.
2 Interpretation
In this order, unless the context otherwise requires,—
Financial year has the same meaning as in section 2(1) of the Public Finance Act 1989
General administrative functions means setting standards, inspection, enforcement, monitoring, surveillance, provision of advice or information, education, direct control (including biological control) of pests, research into biological control, administration, or management
Wellington Regional Plant Pest Management Strategy means the pest management strategy approved by the Wellington Regional Council on 2 July 1996.
3 Pest control on land administered by Department of Conservation

(1) The Wellington Regional Plant Pest Management Strategy applies to the Crown to the extent that the Crown must,—
(a) So far as is practicable, carry out work in accordance with that strategy, to the value of $23,800 each financial year, on land owned by the Crown and administered by the Department of Conservation under the Conservation Act 1987 or under any Act listed in Schedule 1 of the Conservation Act 1987:
(b) Pay the amount of $3,408 each financial year to the Wellington Regional Council for general administrative functions as specified in that strategy.
4 Additional limitations on work
The Crown's obligation to carry out work applies only to the pests specified in the Schedule and the obligation does not exceed the amount specified for that pest.
5 Application of order
This order applies to the financial years commencing on 1 July 1998, 1 July 1999, and 1 July 2000.
