Fisheries (South-East Area Commercial Fishing) Amendment Regulations 1998

These regulations are administered in the Ministry of Fisheries.
PURSUANT to section 89 of the Fisheries Act 1983 and sections 297 and 298 of the Fisheries Act 1996, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following regulations.

1 Title and commencement

(1) These regulations may be cited as the Fisheries (South-East Area Commercial Fishing) Amendment Regulations 1998, and are part of the Fisheries (South-East Area Commercial Fishing) Regulations 19861 (
“the principal regulations”
).(2) These regulations come into force on the 28th day after the date of their notification in the Gazette.
2 Trawling by vessels over 46 m long prohibited in certain waters
Regulation 4A of the principal regulations is amended by omitting the expression
“43 m”
, and substituting the expression“46 m”
.
3 Restriction on taking cockles from Port Levy

(1) The principal regulations are amended by revoking the regulation 10A that was inserted by regulation 4 of the Fisheries (South-East Area Commercial Fishing) Regulations 1986, Amendment No 20 (SR 1995/236).
(2) The principal regulations are amended by inserting, after regulation 10C, the following regulation:
“10D

“(1) No person may take any cockle from the Port Levy area during the period 5 November 1998 to 30 September 2001 (both dates inclusive), or be in possession of any cockle taken from that area during that period.
“(2) In this regulation Port Levy area means all those waters of Port Levy lying to the south of a line drawn from Adderley Head (at 43° 36.36'S and 172° 49.66'E) to Baleine Point (at 43° 36.33'S and 172° 51.19'E).”

4 Targeting of certain fish, aquatic life, and seaweed prohibited, unless specially authorised

Regulations 4 and 5 were revoked, as from 1 October 2001, by regulation 13(f) Fisheries (South-East Area Commercial Fishing) Amendment Regulations (No 3) 2001 (SR 2001/273).
5 Species that may be taken subject to competitive or individual quotas, method restrictions, etc

Regulations 4 and 5 were revoked, as from 1 October 2001, by regulation 13(f) Fisheries (South-East Area Commercial Fishing) Amendment Regulations (No 3) 2001 (SR 2001/273).
6 Yellow-eyed mullet season and quotas
Regulation 11B of the principal regulations is revoked.
7 Seaperch season and quotas
Regulation 11JB of the principal regulations is revoked.
8 Restrictions on fishing methods
Regulation 11K(3) of the principal regulations is amended by omitting the word
“seaperch”
.
9 Taking of eels from Lakes Forsyth and Ellesmere and Wainono Lagoon restricted
10 Eel fishing in male shortfinned eel migration area between 1 February and 31 May

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force 28 days after their notification in the Gazette, amend the Fisheries (South-East Area Commercial Fishing) Regulations 1986 by—
(a) Increasing from 43 m to 46 m the maximum size of fishing vessels that may trawl in certain waters; and
(b) Removing various limitations in relation to certain species that will be redundant once those species come within the quota management system from 1 October 1998; and
(c) Extending for a further 3 years (until September 2001) the prohibition on the taking of cockles from Port Levy; and
(d) Rolling over the existing provisions applying to Te Waihora (Lake Ellesmere) eel fishery by removing the sunset provision.
