Pursuant to sections 186 and 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title

These regulations are the Fisheries (Kaimoana Customary Fishing) Amendment Regulations 2008.

2 Commencement

These regulations come into force on the 28th day after the date of their notification in the Gazette.

3 Fisheries (Kaimoana Customary Fishing) Regulations 1998 amended

Regulation 3 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 is amended by revoking subclause (2) and substituting the following subclause:
- “(2) These regulations apply only in respect of fisheries resources managed under the Fisheries Act 1983, the Fisheries Act 1996, or any regulations made under either or both of those Acts.”

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend regulation 3 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998. Subclause (2) of that regulation confines the scope of the 1998 Regulations to fisheries managed under fisheries legislation. However, freshwater fisheries are excluded altogether. The amendment removes the exclusion for freshwater fisheries so the 1998 Regulations will apply to all fisheries managed under fisheries legislation.
