These regulations are made under section 167 of the Land Transport Act 1998 on the advice and with the consent of the Executive Council.
Regulations
1 Title
These regulations are the Land Transport (Offences and Penalties) Amendment Regulations 2019.
2 Commencement
These regulations come into force on 1 June 2019.
3 Principal regulations
These regulations amend the Land Transport (Offences and Penalties) Regulations 1999 (the principal regulations).
4 Schedule 1 amended
(1)
In Schedule 1, item relating to Land Transport (Road User) Rule 2004 (61001), item relating to clause 3.8(2), replace “Fail to comply with hand-held stop sign”
with “Fail to comply with manually controlled stop sign”
.
(2)
In Schedule 1, item relating to Land Transport (Road User) Rule 2004 (61001), items relating to clause 8.10(1)(b), (2)(a), and (2)(b), replace “static roll threshold compliance certificate”
with “static roll threshold document of compliance”
.
(3)
In Schedule 1, item relating to Land Transport (Road User) Rule 2004 (61001), insert the items set out in the Schedule of these regulations in their appropriate numerical order.
(4)
In Schedule 1, item relating to Traffic Control Devices 2004 (54002), item relating to clause 13.3, replace “Responsibilities of operators of hand-held stop signs”
with “Responsibilities of operators of manually controlled stop signs”
.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 June 2019, amend Schedule 1 of the Land Transport (Offences and Penalties) Regulations 1999. Those regulations create offences for breaching specified land transport provisions and specify the penalties that apply.
The amendments made by regulation 4 are related to amendments to the Land Transport (Road User) Rule 2004 and Land Transport Rule: Traffic Control Devices 2004. The amendments—
identify 2 new provisions being inserted into the Land Transport (Road User) Rule 2004 as offences, and prescribe maximum fines and infringement fees for breach of those provisions; and
update terminology in existing cross-references to rules.
Regulatory impact assessment
The Ministry of Transport produced a regulatory impact assessment on 12 November 2018 to help inform the decisions taken by the Government relating to the contents of this instrument.
