Pursuant to sections 76 and 140 of the Hazardous Substances and New Organisms Act 1996, His Excellency the Governor-General makes the following regulations, acting—
(a) on the advice and with the consent of the Executive Council; and
(b) on the recommendation of the Minister for the Environment given in accordance with section 141 of that Act.

Regulations
1 Title
These regulations are the Hazardous Substances and New Organisms (Personnel Qualifications) Amendment Regulations 2012.
2 Commencement
These regulations come into force on 1 November 2012.
3 Principal regulations
These regulations amend the Hazardous Substances and New Organisms (Personnel Qualifications) Regulations 2001 (the principal regulations).
4 Regulation 6D amended (Suspension of licence)
In regulation 6D(4)(a), replace
“6A”
with“6A)”
.
5 Regulation 7 amended (Qualifications for hazardous substances enforcement officers)

(1) Revoke regulation 7(2).
(2) In regulation 7(4), delete
“, (2),”

6 Regulation 8 revoked (Transitional qualification for hazardous substances enforcement officers)
Revoke regulation 8.
7 Regulation 9 amended (Qualifications for new organisms enforcement officers)

(1) Revoke regulation 9(1)(a).
(2) Replace regulation 9(3) with:
-
“(3) The person must also know the procedures for determining—
“(a) the nature of the organism; and
“(b) whether or not the organism is a new organism.”

8 Regulation 10 amended (Transitional qualification for new organisms enforcement officers)
In regulation 10(1), after
“came into force”
, insert“ (being 8 December 2000)”

9 Regulation 11 amended (Qualifications for test certifiers)
Replace regulation 11(3)(a) with:
-
“(a) a minimum of 2 years of practical experience of actively undertaking—
“(i) the testing, inspection, enforcement, or handling of substances or equipment, or the design of equipment, regulated under the Hazardous Substances and New Organisms Act 1996; or
“(ii) the operation of systems or equipment for which the test certifier may issue test certificates; or”.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 November 2012, amend the Hazardous Substances and New Organisms (Personnel Qualifications) Regulations 2001.
The amendments—
remove certain criteria for test certifiers and enforcement officers that are now considered to be unnecessary; and
broaden the requirement for practical experience for test certifiers to allow recognition of design and overseas experience; and
delete a provision that is now spent; and
correct a minor typographical error.
