Fisheries (Transfer of Functions, Duties, and Powers to The New Zealand Seafood Industry Council Limited) Amendment Order 2002
Note
This order is administered in the Ministry of Fisheries.
Pursuant to section 296E of the Fisheries Act 1996, Her Excellency the Governor-General, acting—
(a) on the advice and with the consent of the Executive Council; and
(b) on the recommendation of the Minister of Fisheries agreed to, by notice in writing, by The New Zealand Seafood Industry Council Limited,—
makes the following order.

1 Title
-
(1) This order is the Fisheries (Transfer of Functions, Duties, and Powers to The New Zealand Seafood Industry Council Limited) Amendment Order 2002.
(2) In this order, the Fisheries (Transfer of Functions, Duties, and Powers to The New Zealand Seafood Industry Council Limited) Order 20011 is called
“the principal order”
.
2 Commencement
This order comes into force on 11 July 2002.
3 Transfer of chief executive's functions, duties, and powers to SeaFIC
4 Schedule amended
-
(1) The Schedule of the principal order is amended by inserting, after Part 5, the following parts:
“Part 5A
“Statutory duties transferred on and from 11 July 2002“The duties in sections 78(4), 78A(4)(b), 79(2)(b), and 79A(4)(b) of the Act.
“Part 5B
“Functions, duties, and powers in regulations transferred on and from 11 July 2002“The functions, duties, and powers in regulation 15(1) and (2) of the Fisheries (Reporting) Regulations 2001.
“Part 5C
“Non-Statutory functions, duties, and powers transferred on and from 11 July 2002“The following functions, duties, and powers:
“(a) to monitor overfishing thresholds and determine when conditions imposed under section 78(2) of the Act take effect:
“(b) to notify the relevant persons when conditions imposed under section 78(2) or section 78A(1) of the Act cease to apply:
“(c) to administer approvals granted, or conditions imposed, under section 78(6) of the Act.”
(2) Part 7 of the Schedule of the principal order is amended by omitting the expression
“15,”
.

This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force on 11 July 2002, amends the Fisheries (Transfer of Functions, Duties, and Powers to The New Zealand Seafood Industry Council Limited) Order 2001.
The amendments transfer, on and from 11 July 2002, additional functions, duties, and powers of the Chief Executive of the Ministry of Fisheries to The New Zealand Seafood Industry Council Limited.
