These regulations are made under section 144 of the Human Rights Act 1993 on the advice and with the consent of the Executive Council.
Regulations
1 Title
These regulations are the Human Rights Review Tribunal Amendment Regulations 2025.
2 Commencement
These regulations come into force on 25 December 2025.
3 Principal regulations
These regulations amend the Human Rights Review Tribunal Regulations 2002.
4 Regulation 13 amended (Nature of notice to be served on defendant)
In regulation 13(d)(i) and (ii), replace “Tribunal”
with “Chairperson or a Deputy Chairperson”
.
5 Regulation 15 amended (Filing and service of statement of reply)

In regulation 15(3), replace “Tribunal”
with “Chairperson or a Deputy Chairperson”
.

In regulation 15(4), replace “Tribunal”
with “Chairperson or the Deputy Chairperson”

6 Regulation 19 amended (Hearing)
In regulation 19(4)(a) and (b), replace “Tribunal”

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations, which come into force on 25 December 2025, amend the Human Rights Review Tribunal Regulations 2002 (the principal regulations). The principal regulations require a defendant who wishes to file a statement of reply out of time in relation to proceedings brought before the Human Rights Review Tribunal (the Tribunal) to seek the leave of the Tribunal. A full Tribunal needs to be convened to consider those leave applications.
The amendments provide for an application for leave to be made instead to the Chairperson or a Deputy Chairperson of the Tribunal.
