Pursuant to section 4 of the Disabled Persons Employment Promotion Act 1960, Her Excellency the Governor-General, on the recommendation of the Minister of Social Services and Employment (made after consultation with the unions, associations, and organisations referred to in section 5 of that Act), and acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title

This order is the Disabled Persons Employment Promotion Order 2002.

2 Commencement

This order comes into force on the 28th day after the date of its notification in the Gazette.

3 Interpretation

In this order, unless the context otherwise requires,—

Act means the Disabled Persons Employment Promotion Act 1960

exempt organisation means an organisation listed in Schedule 1 or Schedule 2

exemptions means the exemptions granted by clause 4.

4 Exemptions

(1) The organisations listed in Schedules 1 and 2 are exempt from the Minimum Wage Act 1983 for the sheltered workshops listed opposite their names in the second column of those schedules.

(2) The organisations in Schedule 1 are exempt from the Holidays Act 2003 for the sheltered workshops listed opposite their names in the second column of that schedule.
(3) The exemptions are—
- (a) subject to clauses 5 and 6; and
- (b) not limited or affected by the change of name of an exempt organisation.
Subclause (2) was amended, as from 1 April 2004, by section 91(2) Holidays Act 2003 (2003 No 129) by substituting the words “Holidays Act 2003” for the words “Holidays Act 1981”.

5 Exemptions apply to certain persons only

The exemptions apply only to the employment and remuneration of disabled persons employed by an exempt organisation at a sheltered workshop for the purpose of receiving care, treatment, and rehabilitation.

6 Exemptions may lapse

An exemption lapses if—
- (a) the exempt organisation ceases to be approved by the Minister under section 3 of the Act; or
- (b) the sheltered workshop to which the exemptions apply—
  - (i) ceases to be owned or controlled by an exempt organisation; or
  - (ii) ceases to be a sheltered workshop.

7 Revocation

The Disabled Persons Employment Promotion Order 2001 (SR 2001/197) is revoked.

The heading to Schedule 1 was amended, as from 1 April 2004, by section 91(2) Holidays Act 2003 (2003 No 129) by substituting the words “Holidays Act 2003” for the words “Holidays Act 1981”. It previously read “Organisations exempted from Holidays Act 1981 and Minimum Wage Act 1983”.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on the 28th day after the date of its notification in the Gazette, exempts certain organisations from the Minimum Wage Act 1983, or from both that Act and the Holidays Act 1981. The exemption applies to disabled persons employed by an exempt organisation at sheltered workshops owned or controlled by the organisation.

Sheltered workshops are places owned or controlled by organisations that have been approved by the Minister of Social Services and Employment and that operate undertakings whose object is the care, treatment, and rehabilitation of disabled persons.

Issued under the authority of the Acts and Regulations Publication Act 1989.
