Pursuant to section 36(1) of the Energy Efficiency and Conservation Act 2000, His Excellency the Governor-General makes the following regulations acting—
(a) on the advice and with the consent of the Executive Council; and
(b) on the recommendation of the Minister of Energy and Resources, having satisfied the requirements of section 36(2) of that Act.

1 Title
These regulations are the Energy Efficiency (Energy Using Products) Amendment Regulations 2011.
2 Commencement
These regulations come into force on the 28th day after the date of their notification in the Gazette.
3 Principal regulations amended
These regulations amend the Energy Efficiency (Energy Using Products) Regulations 2002.
4 Schedules 1 and 2 substituted
Schedules 1 and 2 of the principal regulations are revoked and new Schedules 1 and 2 contained in the Schedule of these regulations are substituted.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations amend the Energy Efficiency (Energy Using Products) Regulations 2002 (the principal regulations). The regulations come into force on the 28th day after the date of their notification in the Gazette.
Regulation 4 revokes and substitutes Schedules 1 and 2 of the principal regulations.
New Schedule 1 includes all the items in the previous Schedule 1 plus new items relating to the following:
chillers:
close control air conditioners:
external power supplies:
gas water heaters:
set-top boxes.
Items that are brought forward from the previous Schedule 1 are unchanged, or apply new minimum energy performance standards, or incorporate amendments to the current performance standards or testing standards (by operation of section 23 of the Standards Act 1988).
New Schedule 2 contains the same items as in the previous Schedule 2. The items are unchanged, or apply new mandatory energy performance labelling standards, or incorporate amendments to the current labelling standards or testing standards (by operation of section 23 of the Standards Act 1988).
