Pursuant to section 36(1) of the Energy Efficiency and Conservation Act 2000 and section 49 of the Legislation Act 2012, His Excellency the Governor-General makes the following regulations, acting—
(a) on the advice and with the consent of the Executive Council; and
(b) to the extent that the regulations are made in reliance on section 36(1) of the Energy Efficiency and Conservation Act 2000, on the recommendation of the Minister of Energy and Resources made in accordance with section 36(2) of that Act.

Regulations
1 Title
These regulations are the Energy Efficiency (Energy Using Products) Amendment Regulations (No 2) 2013.
2 Commencement
These regulations come into force on 1 April 2014.
3 Principal regulations
These regulations amend the Energy Efficiency (Energy Using Products) Regulations 2002 (the principal regulations).
4 Regulation 3 amended (Interpretation)
In regulation 3, insert in its appropriate alphabetical order:
“VRF system testing standard, in Schedule 1, means any of the following standards:
“(a) ANSI/AHRI 1230-2010 with Addendum 1: Performance Rating of Variable Refrigerant Flow (VRF) Multi-Split Air-Conditioning and Heat Pump Equipment:
“(b) BS EN 14511-3:2011 Air conditioners, liquid chilling packages and heat pumps with electrically driven compressors for space heating and cooling—Part 3: Test methods:
“(c) ISO 15042:2011 Multiple split-system air-conditioners and air-to-air heat pumps—Testing and rating for performance:
“(d) ISO 5151:2010 Non-ducted air conditioners and heat pumps—Testing and rating for performance”.
5 Schedule 1 amended

(1) In Schedule 1, second column, items relating to each product class identified in column A of the table in Part 1 of Schedule 1 of these regulations (the table), replace each corresponding item in column B of the table with the item set out opposite it in column C of the table.
(2) In Schedule 1, insert in its appropriate alphabetical order the item set out in Part 2 of Schedule 1 of these regulations.
6 Schedule 2 amended
In Schedule 2, second column, items relating to each product class identified in column A of the table in Schedule 2 of these regulations (the table), replace each corresponding item in column B of the table with the item set out opposite it in column C of the table.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 April 2014, amend the Energy Efficiency (Energy Using Products) Regulations 2002 (the principal regulations).
Schedule 1 of the principal regulations incorporates, by reference, standards for minimum energy performance and testing for certain product classes. Schedule 1 is amended to—
reincorporate, by reference, the minimum energy performance standard applicable to computer monitors (to give effect to an amendment made to that standard on 19 August 2013); and
reincorporate, by reference, the minimum energy performance standard applicable to computers (to give effect to an amendment made to that standard on 22 March 2013); and
incorporate, by reference, the latest versions of the minimum energy performance standards applicable to existing classes of air conditioners and heat pumps; and
incorporate, by reference, a minimum energy performance standard and testing standards for an additional product class: multiple split-system air conditioners and air-to-air heat pumps.
Schedule 2 of the principal regulations incorporates, by reference, standards for mandatory energy performance labelling and testing for certain product classes. Schedule 2 is amended to—
reincorporate, by reference, the mandatory energy performance labelling standard applicable to computer monitors (to give effect to an amendment made to that standard on 19 August 2013); and
incorporate, by reference, the latest version of the mandatory energy performance labelling standard applicable to an existing class of air conditioners and heat pumps.
By virtue of regulations 17 and 18 of the principal regulations, the amendments made by these regulations in respect of a product class apply only to items in that product class that were manufactured in New Zealand, or imported into New Zealand, on or after 1 April 2014.
Access to material that these regulations incorporate by reference into the principal regulations is facilitated by the chief executive of the Ministry of Business, Innovation, and Employment in the ways required by section 52 of the Legislation Act 2012.
