Fisheries (Infringement Offences) Amendment Regulations 2003
Note
These regulations are administered in the Ministry of Fisheries.
Pursuant to section 297 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
-
(1) These regulations are the Fisheries (Infringement Offences) Amendment Regulations 2003.
(2) In these regulations, the Fisheries (Infringement Offences) Regulations 20011 are called
“the principal regulations”
.
2 Commencement
These regulations come into force on 31 March 2003.
3 Schedule 1 amended
Schedule 1 of the principal regulations is amended by inserting in the items relating to the Fisheries (Amateur Fishing) Regulations 1986, in their appropriate order and in the appropriate columns, the following items:
r 9(1) Using or setting a net that, either by itself or together with any other net, extends more than one-quarter across the width of any river, stream, or channel (as measured in accordance with the regulations) 250 r 9(2) Using or setting a net that, either by itself or together with or in conjunction with any other net, wing, or leader extends more than one-quarter of the width of any arm of the sea, including any estuary, inlet, bay or sound (as measured in accordance with the regulations) 250

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 31 March 2003, amend the Fisheries (Infringement Offences) Regulations 2001 by including offences against regulation 9 of the Fisheries (Amateur Fishing) Regulations 1986 as infringement offences carrying an infringement fee of $250. The offences concerned are-
•using or setting a net that, either by itself or together with any other net, extends more than one-quarter across the width of any river, stream, or channel (regulation 9(1)):
•using or setting a net that, either by itself or together with or in conjunction with any other net, wing, or leader extends more than one-quarter of the width of any arm of the sea, including any estuary, inlet, bay, or sound (regulation 9(2)).
