Fisheries (Interim and Annual Deemed Values) Notice 2003 Amendment Notice 2009: revoked, on 29 September 2015, pursuant to clause 9(1) of the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015 (LI 2015/211).

Notice

1 Title

This notice is the Fisheries (Interim and Annual Deemed Values) Notice 2003 Amendment Notice 2009.

2 Commencement

This notice comes into force on 31 March 2009.

3 Application

This notice applies on and from the fishing year commencing on 1 April 2009.

4 Principal notice amended

This notice amends the Fisheries (Interim and Annual Deemed Values) Notice 2003.

5 Application

Clause 3 is amended by adding the following paragraph:

(d)

all subsequent fishing years commencing on 1 October or 1 February or 1 April.

6 Interpretation

Clause 4(2) is amended by omitting “Schedules 1 and 2” and substituting “of the schedules”.

7 Schedule 1A amended

Schedule 1A is amended by omitting the item relating to SBW6A, SBW6B, SBW6I, and SBW6R and inserting the item set out in the Schedule of this notice in its appropriate alphanumerical order.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice amends the Fisheries (Interim and Annual Deemed Values) Notice 2003 by amending the current two-step differential deemed value regime for southern blue whiting stocks SBW6A, SBW6B, SBW6I, and SBW6R to a three-step differential deemed value regime as follows:

catch not in excess of ACE by more than 2% (annual deemed value rate is the amount per kilogram specified for that stock in the third column of Schedule 1):
catch in excess of ACE of more than 2% but not more than 50% (annual deemed value rate is $0.50 per kg):
catch in excess of ACE of more than 50% (annual deemed value rate is $0.72 per kg).

The new values apply on and from the fishing year commencing on 1 April 2009.

The notice also makes 2 technical amendments.

The notice comes into force on 31 March 2009, and applies on and from the fishing year commencing on 1 April 2009.
