These regulations are administered by the Ministry of Health.

Pursuant to sections 94(1)(b) and 105 of the Medicines Act 1981, Her Excellency the Administrator of the Government, acting on the advice of the Minister of Health tendered after consultation with the organisations and bodies that appeared to the Minister to be representative of persons likely to be substantially affected, and on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title

These regulations are the Medicines (Related Products (Exempted Foods)) Regulations 2003.

2 Commencement

These regulations come into force on 15 January 2004.

3 Expiry

4 Certain foods not related products

4A Certain foods that comply with Standard 1.2.7 are not related products

(1)

A food is not a related product for the purposes of the Medicines Act 1981 if—

(a)

a health claim is made in relation to it; and

(b)

that claim is made in a manner that complies with Standard 1.2.7.

In this regulation,—

health claim has the same meaning as in clause 2 of Standard 1.2.7

Standard 1.2.7 means Standard 1.2.7—Nutrition, Health and Related Claims of the Australia New Zealand Food Standards Code—

(a)

set out in 3 New Zealand Gazette 91 at 93 on 18 January 2013; and

(b)

notified in 42 New Zealand Gazette 1211 at 1250 on 11 April 2013; and

(c)

that came into force on 9 May 2013.

4B Foods exempt from certain labelling requirements are not related products

(1)

A food is not a related product for the purposes of the Medicines Act 1981 if it is exempt under Part 3 of the Food (Exemption of Food for Export) Regulations 2025 from a labelling requirement in any of the following:

(a)

an adopted joint food standard:

(b)

the New Zealand Food (Supplemented Food) Standard 2016:

(c)

the Dietary Supplements Regulations 1985.

In this regulation,—

adopted joint food standard has the meaning given in section 8(1) of the Food Act 2014

labelling requirement has the meaning given in regulation 3 of the Food (Exemption of Food for Export) Regulations 2025

Part 3 of the Food (Exemption of Food for Export) Regulations 2025 means Part 3 of the Food (Exemption of Food for Export) Regulations 2025 as enacted on 25 September 2025.

Regulation 4B: inserted, on 25 September 2025, by regulation 4 of the Medicines (Related Products (Exempted Foods)) Amendment Regulations 2025 (SL 2025/192).

5 Revocation

The Medicines (Related Products (Exempted Foods)) Regulations 2002 (SR 2002/208) are revoked.

1 General

This is a consolidation of the Medicines (Related Products (Exempted Foods)) Regulations 2003 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
