Order

1 Title

This order is the Misuse of Drugs (Changes to Controlled Drugs) Order 2003.

2 Commencement

This order comes into force on a date to be appointed by an Order in Council made under section 4A(1) of the Misuse of Drugs Act 1975.

3 Interpretation

In this order, Act means the Misuse of Drugs Act 1975.

4 First Schedule amended

Clause 1 of the First Schedule of the Act is amended by inserting, after the name of the substance that begins with the word “MESCALINE”, the name of the following substance:

“METHAMPHETAMINE (2-methylamino-1-phenylpropane).”

5 Second Schedule amended

(1) Clause 1 of Part 1 of the Second Schedule of the Act is amended by inserting, after the name of the substance that begins with the word “CANNABIS”, the name of the following substance:

“METHCATHINONE.”

(2) Clause 1 of Part 2 of the Second Schedule of the Act is amended by omitting the name of the substance that begins with the word “METHAMPHETAMINE”.

(3) Clause 1 of Part 2 of the Second Schedule of the Act is amended by inserting, after the name of the substance that begins with the word “METHYLPHENIDATE”, the name of the following substance:

“4-METHYLTHIOAMPHETAMINE.”

6 Third Schedule amended

Clause 1 of Part 5 of the Third Schedule of the Act is amended by inserting, in their appropriate alphabetical order, the names of the following substances:

“AMINOREX.

“PEMOLINE.”

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order amends the First, Second, and Third Schedules of the Misuse of Drugs Act 1975 by—

changing the classification of the drug methamphetamine from a class B drug (posing a high risk of harm) to a class A drug (posing a very high risk of harm):
classifying the drugs methcathinone and 4-MTA as class B drugs (posing a high risk of harm):
classifying the drugs aminorex and pemoline as class C drugs (posing a moderate risk of harm).

This order requires the approval of the House of Representatives. If the House of Representatives approves the order, it will come into force on a date specified in a separate commencement order.
