Pursuant to section 77 of the Fisheries Act 1996, Her Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council, makes the following order.

  • This order comes into force on 31 March 2003.

3 Application

  • This order applies on and after 1 April 2003.

4 Over-fishing threshold for Chatham Islands scallops

  • The Schedule of the principal order is amended by inserting in the item relating to scallops, after the entry for SCA1, the following entry:

    SCA4 5 25

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which takes effect on 1 April 2003, amends the Fisheries (Over-Fishing Thresholds for Quota Management Stocks) Order 2001 to set an over-fishing threshold and tolerance level in relation to Chatham Islands scallops. The over-fishing threshold is set at 5% of a fisher's annual catch entitlement, and the tolerance level is set at 25 kilograms.
