Pursuant to section 13(2)(c) of the Ministry of Energy (Abolition) Act 1989, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.
Order
1 Title
This order is the Energy Services (Gas) Order 2003.
2 Commencement
This order comes into force on 31 March 2003.
3 Gas services are services to which section 13 of Ministry of Energy (Abolition) Act 1989 applies

Gas services are declared to be services to which section 13 of the Ministry of Energy (Abolition) Act 1989 applies.

In this clause, gas services includes services in connection with either or both gas transmission or gas distribution.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force on 31 March 2003, declares gas services (including services in connection with gas transmission and gas distribution) to be services to which section 13 of the Ministry of Energy (Abolition) Act 1989 applies.
This order will allow the Minister of Energy to exercise and perform, in relation to gas services, all of the powers and duties conferred on the Minister of Commerce under sections 53, 54, and 56 of the Commerce Act 1986 (the Act). These powers include the power to request the Commerce Commission to report to the Minister on whether or not an Order in Council under section 53 of the Act (which relates to the imposition of control) should be made, amended, or revoked.

1 General
This is a consolidation of the Energy Services (Gas) Order 2003 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
