Fisheries (Central Area Amateur Fishing) Amendment Regulations 2004: revoked, on 1 February 2014, pursuant to regulation 161(1)(c) of the Fisheries (Amateur Fishing) Regulations 2013 (SR 2013/482).

These regulations are administered in the Ministry for Primary Industries.

Pursuant to section 297 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title

(1) These regulations are the Fisheries (Central Area Amateur Fishing) Amendment Regulations 2004.

(2) In these regulations, the Fisheries (Central Area Amateur Fishing) Regulations 1986¹are called “the principal regulations”.

2 Commencement

These regulations come into force on 1 October 2004.

3 Interpretation

Regulation 2A of the principal regulations is amended by inserting, in their appropriate alphabetical order, the following definitions:

“parore means the fish that has the scientific name Girella tricuspidata

“porae means the fish that has the scientific name Nemadactylus douglasii

“red snapper means the fish that has the scientific name Centroberyx affinis”.

4 Maximum daily number of fish

Regulation 3A(1) of the principal regulations is amended by inserting, in their appropriate alphabetical order, the items “Parore”, “Porae”, and “Red snapper”.

5 Person and vessel limits on number of rock lobster pots in Gisborne, Hawke's Bay, and Wellington waters

Regulation 3C of the principal regulations is revoked.

6 New regulation substituted

The principal regulations are amended by revoking regulation 4A, and substituting the following regulation:
“4A Set netting prohibited in Pauatahanui Inlet

No person may use a set net in the waters of Pauatahanui Inlet lying inside a line drawn from North End (at 41°06.27'S and 174°52.18'E) and South End (at 41°06.33'S and 174°52.18'E)”.

7 Offences and penalties

Regulation 6 of the principal regulations is amended—
- (a) by omitting from subclause (1) the expression “3C(2)(a) or (3)(a),”:
- (b) by omitting from subclause (2) the expression “3C(2)(b) or 3C(3)(b),”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 October 2004, amend the Fisheries (Central Area Amateur Fishing) Regulations 1986 to—

•set maximum daily limits for parore, porae, and red snapper:
•revoke regulation 3C, which sets rock lobster pot limits for Gisborne, Hawke's Bay, and Wellington waters in light of the setting of national limits covering all areas in amendments to the Fisheries (Amateur Fishing) Regulations 1986:
•correct co-ordinates in relation to the prohibition on set net-ting in Pauatahanui Inlet.
