Pursuant to section 43 of the Resource Management Act 1991, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations
1 Title
These regulations are the Resource Management (National Environmental Standards Relating to Certain Air Pollutants, Dioxins, and Other Toxics) Amendment Regulations 2008.
2 Commencement
These regulations come into force on the 28th day after the date of their notification in the Gazette.
3 Principal regulations amended
These regulations amend the Resource Management (National Environmental Standards Relating to Certain Air Pollutants, Dioxins, and Other Toxics) Regulations 2004.
4 Interpretation
Regulation 3(1) is amended by inserting the following definition in the appropriate alphabetical order:
“firefighter means a member of a fire brigade to which the Fire Service Act 1975 applies, including a member of a defence fire brigade or an industrial fire brigade, within the meaning of that Act”.
5 Burning of coated wire
Regulation 9 is amended by revoking subclause (2) and substituting the following subclause:

“(2) Subclause (1) does not apply if the wire is—
-
“(a) burnt at industrial and trade premises that have—
“(i) a resource consent for the discharge produced; and
“(ii) emission control equipment that is designed and operated to minimise emissions of dioxins and other toxics from the process; or
“(b) part of a building that is burnt for the purpose of training firefighters.”

6 Burning of oil
Regulation 10(2) is amended by revoking paragraph (b) and substituting the following paragraph:
“(b) the burning is for the purpose of training firefighters; or”.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on the 28th day after their notification in the Gazette, amend the Resource Management (National Environmental Standards Relating to Certain Air Pollutants, Dioxins, and Other Toxics) Regulations 2004. The amendments allow the burning of coated wire that is part of a building if the building is burnt for the purpose of training firefighters.
