Fisheries (Registers) Amendment Regulations 2004
Note
These regulations are administered in the Ministry of Fisheries.
Pursuant to section 297(1)(s) of the Fisheries Act 1996, Her Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
-
(1) These regulations are the Fisheries (Registers) Amendment Regulations 2004.
(2) In these regulations, the Fisheries (Registers) Regulations 20011 are called
“the principal regulations”
.
2 Commencement
These regulations come into force on the 28th day after the date of their notification in the Gazette.
3 Particulars to be shown in Quota Registers

(2) Regulation 4(2) of the principal regulations is amended by adding the following paragraph:
-
“(m) whether or not a settlement quota interest has been registered over the quota shares and, if an interest has been registered,—
“(i) the number of quota shares subject to the interest; and
“(ii) the time and date of the registration of the interest; and
“(iii) the time and date of the withdrawal of the interest, if applicable.”

4 Particulars to be shown in Permit Register

(1) Regulation 6 of the principal regulations is amended by revoking paragraph (f), and substituting the following paragraphs:
“(f) whether or not the permit authorises the taking of stocks subject to the quota management system and non-quota management system stocks not listed in Schedule 4C of the Act:
“(fa) details of any stocks listed in Schedule 4C of the Act that may be taken under the authority of each permit.”
(2) Regulation 6(g) of the principal regulations is amended by omitting the words
“non-quota management system species”
, and substituting the words“stocks listed in Schedule 4C of the Act”
.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend the Fisheries (Registers) Regulations 2001 by—
•revoking regulation 4(2)(c), which is now redundant; and
•inserting a requirement that information on settlement quota interests be included in the quota register (new regulation 4(2)(m)); and
•including references to the new Schedule 4C of the Fisheries Act 1996 (new regulation 6(f) and (fa), and amendment to regulation 6(g)).
