Note
This order is administered in the Ministry of Fisheries.
Pursuant to section 296B of the Fisheries Act 1996, Her Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council, and on the recommendation of the Minister of Fisheries after consulting the Minister for the Environment, makes the following order.

1 Title

(1) This order is the Fisheries (Transfer of Functions, Duties, and Powers to The New Zealand Seafood Industry Council Limited) Amendment Order 2004.
(2) In this order, the Fisheries (Transfer of Functions, Duties, and Powers to The New Zealand Seafood Industry Council Limited) Order 20011 is called
“the principal order”
.
2 Commencement
This order comes into force on the 28th day after the date of its notification in the Gazette.
3 Transfer of chief executive's functions, duties, and powers to SeaFIC
Clause 5 of the principal order is amended by adding the following paragraph:
“(d) Part 9 of the Schedule are transferred to SeaFIC on and from the commencement date of the Fisheries (Transfer of Functions, Duties, and Powers to The New Zealand Seafood Industry Council Limited) Amendment Order 2004.”
4 Schedule amended

(1) Part 1 of the Schedule of the principal order is amended by omitting the expression
“337(4) and (5); 340; 340A;”
.(2) Part 1 of the Schedule of the principal order is amended by omitting the expression
“342(5); 343; 345; 347 to 348; 349; and 369G”
, and substituting the expression“345; 347; and 348”
.(3) The Schedule of the principal order is amended by adding the Part 9 set out in the Schedule of this order.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force on the 28th day after the date of its notification in the Gazette, amends the Fisheries (Transfer of Functions, Duties, and Powers to The New Zealand Seafood Industry Council Limited) Order 2001 by—
•adding a new clause 5(d); and
•amending Part 1 of the Schedule; and
•adding a new Part 9 of the Schedule.
New clause 5(d) provides that the functions, duties, and powers set out in the new Part 9 of the Schedule are transferred to SeaFIC on and from the commencement date of the Fisheries (Transfer of Functions, Duties, and Powers to The New Zealand Seafood Industry Council Limited) Amendment Order 2004.
The amendments to Part 1 of the Schedule remove references to provisions of the Fisheries Act 1996 that have been repealed.
