This order is administered in the Department of Conservation.

Pursuant to section 150C(l) of the Resource Management Act 1991, Her Excellency the Governor-General makes the following order, acting—

(a) on the advice and with the consent of the Executive Council; and

(b) on the recommendation of the Minister of Conservation, who is satisfied of the matters set out in section 150C(2)(b) of the Resource Management Act 1991.

Description of area in Kaipara Harbour

1 Title

This order is the Resource Management (Earlier Expiry of Moratorium—Kaipara Harbour) Order 2004.

2 Commencement

This order comes into force on 2 December 2004.

3 Interpretation

In this order, moratorium has the same meaning as in section 150A of the Resource Management Act 1991.

4 Earlier expiry of moratorium in relation to Kaipara Harbour

The date specified as the date on which the moratorium ends in relation to the area in Kaipara Harbour described in the Schedule is 2 December 2004.

The area referred to in clause 4—

(a) is situated in the coastal marine area in Kaipara Harbour; and

(b) is a quadrilateral area of 100 ha, the corners of which are defined by the intersections of the following lines of latitude and longitude:
- (i) 36°26.06'S and 174°20.00'E:
- (ii) 36°26.20'S and 174°19.48'E:
- (iii) 36°25.44'S and 174°18.41'E:
- (iv) 36°25.30'S and 174°18.52'E.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 2 December 2004, specifies 2 December 2004 as the date for the earlier expiry of the moratorium in relation to a 100 ha area situated in the Kaipara Harbour coastal marine area.

The moratorium, which began on 28 November 2001, prevents a consent authority from processing or determining applications for coastal permits for aquaculture activities.

Without this order the moratorium in relation to the specified area of the Kaipara Harbour would have continued in force until 31 December 2004.
