Fisheries (Declaration of New Stocks Subject to Quota Management System) Amendment Notice 2005

Note

This notice is administered in the Ministry of Fisheries.

Pursuant to section 19(5) of the Fisheries Act 1996, the Minister of Fisheries gives the following notice.

2 Commencement

  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Schedule 3 amended

  • Schedule 3 of the principal notice is amended—

    • (a) by omitting from paragraph (d) of the item relating to quota management area 7A—West Coast the expression “44°30.0'S”, and substituting the expression “40°30.0'S”:

    • (b) by omitting from paragraph (b) of the item relating to quota management area 7B—North and West of Farewell Spit the expression “174°30.0'E”, and substituting the expression “174°17.1'E”.

4 Schedule 5 amended

  • (1) Schedule 5 of the principal notice is amended by revoking the item relating to quota management area 2A—Part Central (East), and substituting the following item:

    “Quota management area 2A—Part Central (East)

    “All that area of New Zealand fisheries waters described in Part 1 of Schedule 1 of the Fisheries Act 1996 as fishery management area 2—Central (East), but excluding—

    • “(a) all that area of New Zealand fisheries waters described in Part 3 of Schedule 1 of the Fisheries Act 1996 as quota management area SCA1—Northland scallop fishery; and

    • “(b) the area enclosed by a line—

      • “(i) commencing at a point at approximately 41°06.2'S and approximately 174°26.5'E; then

      • “(ii) proceeding due east to a point at 41°06.2'S and 174°30.0'E; then

      • “(iii) proceeding due south to a point at 41°13.0'S and 174°30.0'E; then

      • “(iv) proceeding due west to a point at 41°13.0'S and 174°28.15'E; then

      • “(v) proceeding in a north-westerly direction back to the point of commencement.”

    (2) Schedule 5 of the principal notice is amended by omitting from paragraph (b) of the item relating to quota management area 7B—North and West of Farewell Spit the expression “174°30.0'E”, and substituting the expression “174°17.1'E”.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, corrects certain co-ordinates and descriptions of quota management areas for dredge oysters and scallops contained in the Fisheries (Declaration of New Stocks Subject to Quota Management System) Notice 2005.
