Note
These regulations are administered in the Department of Building and Housing.
Pursuant to section 402 of the Building Act 2004, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister for Building Issues, makes the following regulations.

1 Title
-
(1) These regulations are the Building (Forms) Amendment Regulations (No 2) 2005.
(2) In these regulations, the Building (Forms) Regulations 20041 are called
“the principal regulations”
.
2 Commencement
These regulations come into force on 21 July 2005.
3 Other forms
The table in regulation 5 of the principal regulations is amended by adding the following items:
15 363A(1) Application for certificate for public use 16 363A(3) Certificate for public use
4 Agreement between residential property developer and purchaser
5 Warrant of fitness
6 Application for determination
Form 14 in Part 2 of the Schedule of the principal regulations is amended by inserting, after subparagraph (iii) of paragraph (c), the following subparagraph:
“†(iiia) †issue/†refuse to issue/a certificate for public use for the following †premises/†part of premises [state details of the premises or part of premises]”.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 21 July 2005, amend the Building (Forms) Regulations 2004 (“the principal regulations”
).
The regulations prescribe 2 new forms required for the application and issue of certificates for public use. A certificate for public use, provided for by a recent amendment to the Building Act 2004, may be issued for premises (or part) affected by a building work if the territorial authority concerned is satisfied that the premises (or part) can be safely used by members of the public.
The regulations also make minor amendments to certain forms in the principal regulations.
