This order is made under section 6 of the Human Assisted Reproductive Technology Act 2004—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Health given after advice tendered, in accordance with section 6(2) of that Act, by the advisory committee established under section 32 of that Act.
Order
1 Title
This order is the Human Assisted Reproductive Technology Amendment Order 2021.
2 Commencement
This order comes into force on 17 May 2021.
3 Principal order
This order amends the Human Assisted Reproductive Technology Order 2005 (the principal order).
4 Clause 3 amended (Interpretation)
In clause 3, insert in its appropriate alphabetical order:
cryopreserved ovarian tissue means ovarian tissue that has undergone the established procedure of ovarian tissue cryopreservation
5 Schedule amended
(1)
In the Schedule, Part 1, after the item relating to pre-implantation genetic diagnosis (PGD), insert:
Re-implantation of cryopreserved ovarian tissue into woman from whom it was excised
A procedure in which cryopreserved ovarian tissue is re-implanted into the woman from whom the ovarian tissue was excised.

In the Schedule, Part 2, revoke clause 3.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force on 17 May 2021, amends the Human Assisted Reproductive Technology Order 2005 (the principal order).
This order amends the principal order to declare as an established procedure the re-implantation of cryopreserved ovarian tissue into the woman from whom the ovarian tissue was excised.
A procedure that is declared an established procedure does not require the written approval of the ethics committee before it may be performed (see sections 5, 6, and 16 of the Human Assisted Reproductive Technology Act 2004).
