Pursuant to section 36(1) of the Energy Efficiency and Conservation Act 2000, Her Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Energy (having satisfied the requirements of section 36(2) of that Act), makes the following regulations.

1 Title

These regulations are the Energy Efficiency (Energy Using Products) Amendment Regulations 2006.

2 Commencement

These regulations come into force on the day after the date of their notification in the Gazette.

3 Principal regulations amended

These regulations amend the Energy Efficiency (Energy Using Products) Regulations 2002.

4 Interpretation

Regulation 3 is amended by inserting the following definitions in their appropriate alphabetical order:

“AS means Australian Standard

“AS/NZS means a joint Australian and New Zealand Standard

“NZS means New Zealand Standard.”

5 New heading and regulations 17 and 18 inserted

The following heading and regulations are inserted after regulation 16:
“Application of regulations to certain items if standard in Schedule 1 or Schedule 2 replaced or new standard added
“17 Application of regulations to certain items if standard in Schedule 1 or Schedule 2 replaced

“(1) This regulation applies to an item if—

“(a) the item belongs to a product class listed in Schedule 1 or Schedule 2; and

“(b) a standard referred to in the Schedule that applies to the product class is replaced with a new or revised standard; and

“(c) the item—

“(i) was manufactured in New Zealand before the date on which the new or revised standard was included in the Schedule; or

“(ii) was imported into New Zealand before the new or revised standard was included in the Schedule.

“(2) Regulations 4 to 7 apply to an item as if the standard had not been replaced by the new or revised standard.
“18 Application of regulations to certain items if new standard added to Schedule 1 or Schedule 2

“(1) This regulation applies to an item if—

“(a) the item belongs to a product class listed in Schedule 1 or Schedule 2; and

“(b) a reference to a new standard is added to the Schedule and applies to the product class; and

“(c) the item—

“(i) was manufactured in New Zealand before the date on which the new standard was added in the Schedule; or

“(ii) was imported into New Zealand before the date on which the new standard was added in the Schedule.

“(2) Regulations 4 to 7 apply to an item as if the new standard had not been added in the Schedule.”

6 New Schedule 1 substituted

Schedule 1 is revoked and the Schedule 1 set out in Schedule 1 of these regulations is substituted.

7 New Schedule 2 substituted

Schedule 2 is revoked and the Schedule 2 set out in Schedule 2 of these regulations is substituted.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the day after the date of their notification in the Gazette, amend the Energy Efficiency (Energy Using Products) Regulations 2002 (the principal regulations).

Regulation 4 inserts 3 definitions into the principal regulations.

Regulation 5 inserts new regulations 17 and 18 into the principal regulations. New regulation 17 addresses the situation where an item in a product class to which a standard in Schedule 1 or Schedule 2 of the principal regulations applies has been manufactured or imported into New Zealand and, before the item is sold or otherwise dealt with, the standard is replaced with a new or revised standard. New regulation 17 requires the item to only meet the standard that applied before it was replaced for the purposes of regulations 4 to 7 of the principal regulations.

New regulation 18 is of the same effect as new regulation 17, except that this regulation applies if a completely new standard is imposed on the product class to which the item belongs after the item has been manufactured or imported into New Zealand and before it is sold or otherwise dealt with.

Regulation 6 revokes and substitutes Schedule 1 of the principal regulations in order to—

•cite the standards listed in the schedule by their full title and number (as determined by the Standards Council):
•take account of changes to either or both of the minimum energy performance standards and testing standards for the following product classes:
- •low-pressure copper thermal electric storage water heaters:
- •single-phase ducted air conditioners and air-to-air heat pumps:
- •single-phase non-ducted air conditioners and heat pumps:
- •storage water heaters (electrically heated):
- •three-phase air conditioners and heat pumps (previously classified as three-phase air conditioners):
- •three-phase cage induction motors:
- •tubular fluorescent lamps:
- •ballasts for fluorescent lamps.

Regulation 7 revokes and substitutes Schedule 2 of the principal regulations in order to—

•cite the standards listed in the schedule by their full title and number (as determined by the Standards Council):
•omit the product class of single-phase ducted air conditioners and air-to-air heat pumps. This product class is no longer subject to the requirements of regulations 6(1) and 7(1) of the principal regulations:
•take account of changes to the mandatory energy performance labelling standards for single-phase non-ducted air conditioners and air-to-air heat pumps.
