Traffic Amendment Regulations 2006

Preamble
At Wellington this 27th day of February 2006
Pursuant to sections 167 and 218 of the Land Transport Act 1998, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
-
(1) These regulations are the Traffic Amendment Regulations 2006.
(2) In these regulations, the Traffic Regulations 1976 are called
“the principal regulations”
.
2 Commencement
These regulations come into force on 1 April 2006.
3 Heading above regulation 90A and regulations 90A to 90LA and 90N to 90Q revoked
The principal regulations are amended by revoking—
(a) the heading above regulation 90A; and
(b) regulations 90A to 90LA; and
(c) regulations 90N to 90Q.
4 New regulations 90R and 90S substituted
The principal regulations are amended by revoking regulations 90R and 90S, and substituting the following regulations:
“90R Interpretation
-
“(1) In this Part rule means Land Transport Rule: Vehicle Standards Compliance 2002 (35001/1).
“(2) In this Part, unless the context otherwise requires,—
“(a) terms defined in the rule have the meanings given to them in the rule:
“(b) terms defined in both the rule and in these regulations have the meanings given to them in the rule.
“90S Vehicle identification numbers
-
“(1) This regulation applies to vehicles that—
“(a) were manufactured in New Zealand after 1 February 1994:
“(b) entered New Zealand after 1 February 1994:
“(c) were first registered or re-registered in New Zealand after 1 April 1994.
“(2) Every motor vehicle referred to in subclause (1) must have a valid vehicle identification number affixed.
“(3) Subclause (1)(b) does not include a vehicle referred to in paragraph 6.1(h) of the rule.”

5 Regulations 90T to 90ZC revoked
The principal regulations are amended by revoking regulations 90T to 90ZC.
6 Offences
Regulation 90ZD of the principal regulations is amended by revoking paragraphs (b) and (c), and substituting the following paragraphs:
“(b) affixes to any motor vehicle a vehicle identification number that has not been assigned to that vehicle; or
-
“(c) sells, or offers for sale, any motor vehicle that—
“(i) is required by regulation 90S to have a valid vehicle identification number affixed; and
“(ii) does not have a valid vehicle identification number affixed; or”.
7 Savings

(1) This regulation applies to any person who, before these regulations came into force, committed, or may have committed, an offence against any of regulations 90N to 90Q or regulation 90ZD of the principal regulations (as they were immediately before these regulations came into force).
(2) The principal regulations continue to apply to any person referred to in subclause (1) as if those regulations had not been amended by these regulations.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 April 2006, amend the Traffic Regulations 1976 (“the principal regulations”
) by
•revoking the heading above regulation 90A, regulations 90A to 90LA, and regulations 90N to 90Q (which relate to alternative fuel systems); and
•revoking regulations 90T to 90ZC (which relate to vehicle identification numbers); and
•amending regulation 90ZD.
These amendments are a result of matters relating to alternative fuel systems and vehicle identification numbers (which were previously dealt with in the principal regulations) being dealt with in Land Transport Rule: Vehicle Standards Compliance 2002 (35001/1).
Despite these amendments, regulations 90A to 90ZD of the principal regulations (as they were immediately before 1 April 2006) continue to apply to any person who, before these regulations came into force, committed, or may have committed, an offence against any of regulations 90N to 90Q or regulation 90ZD.
