Pursuant to the Customs and Excise Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title

These regulations are the Customs and Excise (Rules of Origin for Thai Goods) Amendment Regulations 2006.

2 Commencement

These regulations come into force on 18 January 2007.

3 Principal regulations amended

These regulations amend the Customs and Excise Regulations 1996.

4 Originating goods

Regulation 51G(1)(b) is amended by revoking subparagraph (ii) and substituting the following subparagraph:
- “(ii) did not enter the commerce of another country after export from Thailand and before import into New Zealand, unless the Chief Executive otherwise permits subject to conditions approved by the Chief Executive either generally or in a particular case.”

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 18 January 2007, amend the Customs and Excise Regulations 1996.

The amendment permits the Chief Executive of the New Zealand Customs Service to waive the requirement that goods partly manufactured in Thailand must be shipped direct to New Zealand to qualify for preferential tariff treatment. The waiver is subject to general or specific conditions approved by the Chief Executive.
