Community Magistrates (Remuneration and Allowances) Amendment Order 2007

  • Community Magistrates (Remuneration and Allowances) Amendment Order 2007: revoked, on 1 August 2008, by clause 5 of the Community Magistrates (Remuneration and Allowances) Amendment Order 2008 (SR 2008/225).

  • Preamble

    At Wellington this 2nd day of July 2007

Pursuant to section 11G of the District Courts Act 1947, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title

  • This order is the Community Magistrates (Remuneration and Allowances) Amendment Order 2007.

2 Commencement

  • (1) Clause 4 comes into force on 1 July 2006.

    (2) The rest of this order comes into force on the day after the date of its notification in the Gazette.

3 Principal order amended

  • This order amends the Community Magistrates (Remuneration and Allowances) Order 1989.

4 New clause 2 substituted

  • Clause 2 is revoked and the following clause is substituted:

    “2 Remuneration of Community Magistrates (other than Chief Community Magistrate)

    • A Community Magistrate (other than the Chief Community Magistrate) is to be paid remuneration by way of the following fees:

      • “(a) for every day on which he or she attends the Court for 1 hour or less in his or her capacity as a Community Magistrate, a fee of $36:

      • “(b) for every day on which he or she attends the Court for more than 1 hour but not more than 4 hours in his or her capacity as a Community Magistrate, a fee of $60:

      • “(c) for every day on which he or she attends the Court for more than 4 hours but not more than 8 hours in his or her capacity as a Community Magistrate, a fee of $120:

      • “(d) for every day on which he or she attends the Court for more than 8 hours in his or her capacity as a Community Magistrate,—

        • “(i) a fee of $120; and

        • “(ii) further fees of $24 for every hour or part of an hour over 8 hours.”

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, the operative provision of which comes into force retroactively on 1 July 2006, increases the fees payable to Community Magistrates (other than the Chief Community Magistrate).

At present they are paid—

  • •$30 for attending court for 1 hour or less on any day:

  • •$50 for attending court for between 1 hour and 4 hours on any day:

  • •$100 for attending court for between 4 and 8 hours on any day:

  • •$100, plus $20 for every hour or part of an hour over 8 hours, for attending court for over 8 hours on any day. The order increases these fees to $36, $60, $120, and $120 plus $24 per hour or part of an hour.

The remuneration of the Chief Community Magistrate is determined by the Remuneration Authority.
