Preamble
At Wellington this 23rd day of July 2007
Pursuant to section 100A of the Judicature Act 1908, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
1 Title
These regulations are the High Court Fees Amendment Regulations 2007.
2 Commencement
These regulations come into force on 24 August 2007.
3 Principal regulations amended
These regulations amend the High Court Fees Regulations 2001.
4 Payment of fees for determining setting down dates
Regulation 11(1)(b) is amended by omitting
“tenth”
and substituting“thirtieth”
.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 24 August 2007, amend the High Court Fees Regulations 2001. This is required following the amendment to rule 434(5)(a) of the High Court Rules (concerning setting down dates) made by rule 13 of the High Court Amendment Rules 2007. The effect of the amendment is to change the time by which the fee is payable for determination of the setting down date for a proceeding on the standard track. Currently, the fee is payable by the working day before commencement of the substantive proceeding or the tenth working day after the setting down date for the proceeding, whichever is the earlier. Under the amendment, the fee is payable by the earlier of the working day before commencement of the substantive proceeding or the thirtieth day after the setting down date for the proceeding.
