Preamble
At Wellington this 27th day of August 2007
Pursuant to section 296E of the Fisheries Act 1996, His Excellency the Governor-General, acting—
(a) on the advice and with the consent of the Executive Council; and
(b) on the recommendation of the Minister of Fisheries agreed to, by notice in writing, by The New Zealand Seafood Industry Council Limited, makes the following order.

1 Title
This order is the Fisheries (Transfer of Functions, Duties, and Powers to The New Zealand Seafood Industry Council Limited) Amendment Order 2007.
2 Commencement
This order comes into force on 1 October 2007.
3 Principal order amended
This order amends the Fisheries (Transfer of Functions, Duties, and Powers to The New Zealand Seafood Industry Council Limited) Order 2006.
4 Clause 5 substituted
Clause 5 is revoked and the following clause substituted:
“5 Transfer of chief executive's functions, duties, and powers to SeaFIC
The chief executive's functions, duties, and powers listed—
“(a) in Schedule 1 are transferred to SeaFIC on and from 1 October 2006:
“(b) in Schedule 2 are transferred to SeaFIC on and from 1 October 2007.”
5 Schedule amended
The Schedule heading is revoked and the following heading substituted:
Schedule 1 Functions, duties, and powers transferred to SeaFIC on and from 1 October 2006
6 New Schedule 2 added
The schedule set out in the Schedule of these regulations is added as Schedule 2.

The functions, duties, and powers in the following regulations of the Fisheries (Satellite Vessel Monitoring) Regulations 1993:
(a) regulation 5(9):
(b) regulation 6(1):
(c) that part of regulation 6(3) that relates to the cancellation of an automatic location communicator.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force on 1 October 2007, amends the Fisheries (Transfer of Functions, Duties, and Powers to The New Zealand Seafood Industry Council Limited) Order 2006.
The amendments transfer, on and from 1 October 2007, additional functions, duties, and powers of the chief executive of the Ministry of Fisheries to The New Zealand Seafood Industry Council Limited under the Fisheries (Satellite Vessel Monitoring) Regulations 1993. The additional functions, duties, and powers transferred relate to the registration and cancellation of automatic location communicators.
