Fisheries (Infringement Offences) Amendment Regulations 2007

    At Wellington this 26th day of February 2007

Pursuant to section 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title

  • These regulations are the Fisheries (Infringement Offences) Amendment Regulations 2007.

2 Commencement

  • These regulations come into force on 1 April 2007.

3 Principal regulations amended
4 Schedule 1 amended

  • Schedule 1 is amended by inserting in the items relating to the Fisheries (Amateur Fishing) Regulations 1986, in the appropriate order and in the appropriate columns, the following items:

    r 16(1) Possessing a live brown bullhead catfish 750
    r 16(2) Taking a live brown bullhead catfish without killing it immediately 750
5 Schedule 3 amended

  • Schedule 3 is amended by inserting “Infringement notice issued by [insert issuing officer's number]” under “The penalty for the offence is $ [infringement fee]”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 April 2007, amend the Fisheries (Infringement Offences) Regulations 2001.

Schedule 1 is amended to include offences against regulation 16 of the Fisheries (Amateur Fishing) Regulations 1986 as infringement offences carrying an infringement fee of $750. The offences are—

  • •possessing a live brown bullhead catfish (regulation 16(1)):

  • •taking a live brown bullhead catfish without killing it immediately (regulation 16(2)).

Schedule 3, which sets out the form of the reminder notice for a fisheries infringement offence, is amended to insert a reference to the issuing officer's number.
