Fisheries (Interim and Annual Deemed Values) Amendment Notice 2007: revoked, on 29 September 2015, pursuant to clause 9(1) of the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015 (LI 2015/211).

Pursuant to section 75 of the Fisheries Act 1996, the Minister of Fisheries, after consultation in accordance with section 75A of that Act, gives the following notice.

1 Title

This notice is the Fisheries (Interim and Annual Deemed Values) Amendment Notice 2007.

2 Commencement

This notice comes into force on 1 April 2007.

3 Principal notice amended

This notice amends the Fisheries (Interim and Annual Deemed Values) Notice (No 3) 2003.

4 Interpretation

Clause 4(2) is amended by omitting “references in” and substituting “references to fishstock in clauses 5(2) and 6(2) and in”.

5 Interim deemed values

Clause 5 is amended by adding the following subclause as subclause (2):

The interim deemed value to be demanded by the chief executive under section 76(2) of the Act for all stocks of red crab (CHC1 to 10), giant spider crab (GSC1, 3, 5, 6A, 6B, and 10), and king crab (KIC1 to 10) is $1.62 per kilogram.

6 Annual deemed values

Clause 6 is amended by adding the following subclause as subclause (2):

The annual deemed values to be demanded by the chief executive under section 76(2A) and (2B) of the Act for all stocks of red crab (CHC1 to 10), giant spider crab (GSC1, 3, 5, 6A, 6B, and 10), and king crab (KIC1 to 10) are as follows:

(a)

for so much of a commercial fisher’s reported catch as does not exceed the fisher’s ACE by more than 10%, $1.80:

(b)

for so much of a commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 10% but not more than 20%, $8 per kilogram:

(c)

for so much of a commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 20% but not more than 30%, $10 per kilogram:

(d)

for so much of a commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 30% but not more than 40%, $12 per kilogram:

(e)

for so much of a commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 40% but not more than 50%, $14 per kilogram:

(f)

for so much of a commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 50% but not more than 60%, $16 per kilogram:

(g)

for so much of a commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 60% but not more than 70%, $18 per kilogram:

(h)

for so much of a commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 70% but not more than 80%, $20 per kilogram:

(i)

for so much of a commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 80% but not more than 90%, $22 per kilogram:

(j)

for so much of a commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 90% but not more than 100%, $24 per kilogram:

(k)

for so much of a commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 100%, $26 per kilogram.

7 Schedule amended

The Schedule is amended by omitting the items relating to red crab (CHC1 to 10), giant spider crab (GSC1, 3, 5, 6A, 6B, and 10), and king crab (KIC1 to 10).

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on 1 April 2007, amends the Fisheries (Interim and Annual Deemed Values) Notice (No 3) 2003.

The amendments substitute new interim and annual deemed values for all stocks of red crab, giant spider crab, and king crab.
