Regulations

1 Title

These regulations are the Overseas Investment Amendment Regulations (No 2) 2008.

2 Commencement

These regulations come into force on the 28th day after the date of their notification in the Gazette.

3 Principal regulations amended

These regulations amend the Overseas Investment Regulations 2005.

4 Schedule 3 amended

The item relating to HSBC Nominees (New Zealand) Limited in Schedule 3 is omitted.

5 Schedule 4 amended

(1) The item relating to Fisher & Paykel Applicances Holdings Ltd in Schedule 4 is omitted.

(2) Schedule 4 is amended by omitting the item relating to Infrastructure & Utilities NZ Limited and substituting the following item: “Infratil Limited”.

(3) Schedule 4 is amended by adding the following item: “TrustPower Limited”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the 28th day after the date of their notification in the Gazette, update Schedules 3 and 4 of the Overseas Investment Regulations 2005 following the annual review by the Overseas Investment Office of exemptions that arise through the inclusion of persons on the list of Portfolio investors (Schedule 3) or New Zealand controlled persons (Schedule 4).
