Order

1 Title

This order is the Aquaculture Reform (Repeals and Transitional Provisions) (Wilson Bay Interim Aquaculture Management Areas) Order 2008.

2 Commencement

This order comes into force on the 28th day after the date of its notification in the Gazette.

3 Interpretation

(1) In this order,—

Area A means the area specified on the map in Schedule 1 delineated by a bold line and marked “A” on the map

Area B means the area specified on the map in Schedule 1 delineated by a bold line and marked “B” on the map.

(2) If there is any inconsistency between an area specified in the map in Schedule 1 and the description of the area in Schedule 2, the description of the area in Schedule 2 prevails.

4 Areas in Wilson Bay declared to be interim aquaculture management areas

The areas marked as “A” and “B” that are specified in Schedule 2 are declared to be interim aquaculture management areas.

Area A

Area A forms a 4-sided area of 1400.44 ha, the corners of which are defined by the intersections of the following lines of latitude and longitude:

(a) 175°25.358′E and 36°57.082′S:

(b) 175°22.996′E and 36°54.600′S:

(d) 175°26.656′E and 36°56.286′S.

Area A does not include separate areas totalling 690 ha contained in deemed aquaculture management areas under deemed consent numbers 112423, 112703, 112705, 112707 to 112711, 112714, 112715, 113494, 113496 to 113498, 113504, 113505, 113517 to 113534, 113536 to 113541, 113594 to 113624, 113626 to 113635, 113660 to 113664, 113683 to 113731, 113734 to 113762, 113826, 113827, 113829, 113830, and 113831.

Area B

Area B forms a 5-sided area of 1072.56 ha, the corners of which are defined by the intersections of the following lines of latitude and longitude:

(a) 175°23.826′E and 36°58.021′S:

(b) 175°21.638′E and 36°55.722′S:

(d) 175°22.461′E and 36°54.929′S:

(e) 175°24.822′E and 36°57.410′S.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on the 28th day after the date of its notification in the Gazette, declares certain areas in the coastal marine area in Wilson Bay to be interim aquaculture management areas.
