Pursuant to sections 167(1)(j) and 168 of the Land Transport Act 1998, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title

These regulations are the Land Transport (Administrative Fees for Recovery of Unpaid Tolls) Regulations 2008.

2 Commencement

These regulations come into force on 23 January 2009.

3 Interpretation

In these regulations, unless the context otherwise requires,—

Act means the Land Transport Management Act 2003

toll operator has the same meaning as in section 5 of the Act.

4 Fees

(1) A toll operator may charge a reasonable administrative fee for the recovery of an unpaid toll that is a debt arising under section 52(2) of the Act.

(2) The fee is payable by the registered owner of the motor vehicle to which the unpaid toll relates.

(3) The amount of the administration fee may be no more than is necessary to meet the actual and reasonable cost to the toll operator of recovering the debt.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 23 January 2009, authorise a toll operator to charge an administrative fee to cover the extra cost of recovering an unpaid toll from the registered owner of a motor vehicle following default in payment by the driver of the vehicle.
