Fisheries (Interim and Annual Deemed Values) Notice (No 3) 2003 Amendment Notice 2008: revoked, on 29 September 2015, pursuant to clause 9(1) of the Fisheries (Total Allowable Catch, Total Allowable Commercial Catch, and Deemed Value Rates) Notice 2015 (LI 2015/211).

Notice

1 Title

This notice is the Fisheries (Interim and Annual Deemed Values) Notice (No 3) 2003 Amendment Notice 2008.

2 Commencement

This notice comes into force on 31 March 2008.

3 Application

This notice applies on and from the fishing year commencing on 1 April 2008.

4 Principal notice amended

This notice amends the Fisheries (Interim and Annual Deemed Values) Notice (No 3) 2003.

5 Annual deemed rates

(1)

Clause 6 is amended by inserting the following subclause after subclause (1):

Subclause (1) applies subject to subclause (3).

(2)

Clause 6(2)(a) is amended by adding “per kilogram”.

(3)

Clause 6 is amended by adding the following subclause:

The annual deemed values to be demanded by the chief executive under section 76(2A) and (2B) of the Act for stocks of SCC1B and SCC7A are as follows:

(a)

for so much of the commercial fisher’s reported catch as does not exceed the fisher’s ACE by more than 20%, the amounts per kilogram specified for those stocks in the third column of the Schedule (the basic annual deemed value):

(b)

for so much of the commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 20% but not more than 40%, 120% of the basic annual deemed value:

(c)

for so much of the commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 40% but not more than 60%, 140% of the basic annual deemed value:

(d)

for so much of the commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 60% but not more than 80%, 160% of the basic annual deemed value:

(e)

for so much of the commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 80% but not more than 100%, 180% of the basic annual deemed value:

(f)

for so much of the commercial fisher’s reported catch as exceeds the fisher’s ACE by more than 100%, 200% of the basic annual deemed value.

6 Schedule amended

(1)

The Schedule is amended by omitting the items relating to SCC1A, SCC1B, SCC2A, SCC2B, SCC3, SCC4, SCC5A, SCC5B, SCC6, SCC7A, SCC7B, SCC7D, SCC8, and SCC9.

(2)

The Schedule is amended by inserting the items set out in the Schedule of this notice in their appropriate alphanumerical order.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on 31 March 2008, amends the Fisheries (Interim and Annual Deemed Values) Notice (No 3) 2003.

The amendments substitute new interim and annual deemed values for all stocks of sea cucumber (except SCC10).

The new values apply on and from the fishing year commencing on 1 April 2008.
