Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health gives the following notice.
Notice
1 Title
This notice is the Health Practitioners (Quality Assurance Activity—Bi-National Colorectal Cancer Audit) Notice 2009.
2 Commencement
This notice comes into force on the day after the date of its notification in the Gazette.
3 Declaration of protected quality assurance activity
The Bi-National Colorectal Cancer Audit described in the Schedule is a protected quality assurance activity.

1 Interpretation
In this Schedule,—
activity means the Bi-National Colorectal Cancer Audit
CSSANZ means the Colorectal Surgical Society of Australia and New Zealand
participant means a Fellow of the Royal Australasian College of Surgeons who is—
(a) a member of CSSANZ; and
(b) practising in New Zealand; and
(c) involved in the surgical treatment of colorectal cancer.
2 Objective
The objective of the activity is to establish an audit of the treatment of colorectal cancer by participants to ensure that the treatment provided by those participants is performed at the highest possible standard.
3 Information
The activity is based on information provided by Australian and New Zealand surgeons involved in the treatment of colorectal cancer.
4 Activity
-
(1) The activity will be undertaken by CSSANZ in collaboration with the Royal Australasian College of Surgeons and BioGrid Australia.
(2) The activity involves—
(a) collecting data about colorectal cancer patients who are managed by participants; and
(b) collating and analysing the data to provide national standards and comparisons; and
(c) at six-monthly intervals, providing participants with information about their clinical practices and outcomes in relation to their peers; and
(d) using the information to identify, implement, and monitor specific improvements in individual clinical practices; and
-
(e) reporting back annually to participants through CSSANZ on—
(i) trends in clinical practices and outcomes shown by the information collected; and
(ii) any changes in the clinical practices of participants that are desirable in order to respond to the trends.

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice, which comes into force on the day after the date of its notification in the Gazette, declares the quality assurance activity called the Bi-National Colorectal Cancer Audit to be a protected quality assurance activity. The effect of this declaration is that, subject to certain exceptions,—
any information that becomes known solely as a result of the activity is confidential; and
any documents brought into existence solely for the purposes of the activity are confidential; and
the persons who engage in the activity in good faith are immune from civil liability.
Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
