1 Title

This order is the Biosecurity (Small Scale Organism Management) Amendment Order 2009.

2 Commencement

This order comes into force on the 28th day after the date of its notification in the Gazette.

3 Principal order amended

This order amends the Biosecurity (Small Scale Organism Management) Order 1993.

4 New clause 2 substituted

Clause 2 is revoked and the following clause substituted:
“2 Maximum amount prescribed

The amount of $500,000 is prescribed for the purposes of section 100(1)(c) of the Biosecurity Act 1993.”

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

Section 100 of the Biosecurity Act 1993 authorises regional councils (including the Chatham Islands Council and unitary authorities) in certain circumstances to take small scale measures to control an unwanted organism, without first going through procedures to put a pest management strategy in place. The measures may not be taken unless the council is satisfied that taking them is likely to cost less than a maximum amount prescribed by Order in Council. This order, which comes into force on the 28th day after the date of its notification in the Gazette, amends the Biosecurity (Small Scale Organism Management) Order 1993 by substituting a new clause 2. New clause 2 increases the prescribed amount from $100,000 to $500,000.
