Pursuant to section 5(4) of the Health Sector (Transfers) Act 1993, His Excellency the Governor-General, acting on recommendations of the Minister of Finance and the Minister of Health and on the advice and with the consent of the Executive Council, makes the following order.
Order
1 Title
This order is the Health Sector Transfers (Hutt DHB) Amendment Order 2009.
2 Commencement
This order is deemed to have come into force on 4 August 2009.
3 Principal order amended
This order amends the Health Sector Transfers (Hutt DHB) Order 2009.
4 Schedule amended
Clause 4 of the Schedule is amended by revoking paragraph (e) and substituting the following paragraph:

Lot 1 on Deposited Plan 315004, comprised in certificate of title 59246.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order amends the Health Sector Transfers (Hutt DHB) Order 2009 (the original order) to correct an administrative error.
The original order transferred a number of properties on Pilmuir Street in Lower Hutt from Housing New Zealand Corporation to Hutt DHB, including 49 Pilmuir Street. The legal description of 49 Pilmuir Street cited in clause 4(e) of the Schedule to the original order is incorrect, because 49 Pilmuir Street and part of 51 Pilmuir Street were amalgamated onto 1 title, now known as 49 Pilmuir Street, in May 2003. The original order therefore failed to transfer the parcel of land that was formerly part of 51 Pilmuir Street, even though it was the intention of the parties that this parcel of land be transferred.
The amendment approved by this order is deemed to have come into force on the transfer date of 4 August 2009, as authorised by section 5(4) of the Health Sector (Transfers) Act 1993.

1 General
This is a consolidation of the Health Sector Transfers (Hutt DHB) Amendment Order 2009 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
