Notice
1 Title
This notice is the Health Practitioners (Quality Assurance Activity—RCPA Quality Assurance Programs Pty Limited) Notice 2009.
2 Commencement
This notice comes into force on the day after the date of its notification in the Gazette.
3 Declaration of protected quality assurance activity
The RCPA Quality Assurance Programs Pty Limited Key Incident Monitoring and Management System described in the Schedule is a protected quality assurance activity.

1 Interpretation
In this schedule,—
activity means the RCPA Quality Assurance Programs Pty Limited Key Incident Monitoring and Management System
participant means a health practitioner who is participating in the activity and who is—
(a) a pathologist or medical laboratory scientist; and
(b) registered with, or a member of a group registered with, the Royal College of Pathologists of Australasia; and
(c) engaged in laboratory diagnostic processes in New Zealand.
2 Objective
The objective of the activity is to improve—
(a) the standard of practices of the participants; and
(b) the error rate of the participants through improving the quality of laboratory testing processes; and
(c) the competence of the participants.
3 Information
The activity is based on information derived from the participants.
4 Activity
The activity involves—
(a) reporting incidents and errors in the pre-analytical phase of the laboratory testing process (such as issues with patient identification, test ordering, specimen taking, and specimen labelling); and
(b) reporting incidents and errors in the post-analytical phase (such as accuracy and timeliness of result release, results sent to the incorrect place, amendment or retraction of pathology results already issued); and
(c) aggregating the reports received from all participants under paragraphs (a) and (b); and
(d) conducting comparisons on the reports of each participant with the aggregated reports of all participants; and
(e) compiling statistical data in respect of the comparisons undertaken in paragraph (d); and
-
(f) providing to each participant—
(i) the result of the comparison conducted under paragraph (d) in respect of the participant's reports; and
(ii) access to the statistical data compiled under paragraph (e).

Explanatory note
This note is not part of the notice, but is intended to indicate its general effect.
This notice, which comes into force on the day after the date of its notification in the Gazette, declares the RCPA Quality Assurance Programs Pty Limited Key Incident Monitoring and Management System (the activity) to be a protected quality assurance activity. The effect of this declaration is that, subject to certain exceptions,—
any information that becomes known solely as a result of the activity is confidential; and
any documents brought into existence solely for the purposes of the activity are confidential; and
the persons who engage in the activity in good faith are immune from civil liability.
Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
