Pursuant to section 120H(a) of the Tax Administration Act 1994, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
Regulations
1 Title
These regulations are the Taxation (Use of Money Interest Rates Setting Process) Amendment Regulations 2009.
2 Commencement
These regulations come into force immediately after they are made.
3 Principal regulations amended
These regulations amend the Taxation (Use of Money Interest Rates Setting Process) Regulations 1997.
4 Regulation 2 substituted
Regulation 2 is revoked and the following regulation substituted:
2 Taxpayer’s paying rate
For the purposes of section 120E(1)(a) of the Tax Administration Act 1994, the taxpayer’s paying rate must be set at the 90-day bank bill rate plus 450 basis points.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force immediately, change the setting process for the taxpayer’s paying rate, which is the rate payable on unpaid tax.
The change in the setting process is being made because of the current economic climate, and may be reviewed later.
The setting process as prescribed in 1997 is that the rate must be set at the Reserve Bank of New Zealand business base lending rate series plus 200 basis points.
The new setting process is that the rate must be set at the 90-day bank bill rate plus 450 basis points.
Section 120H of the Tax Administration Act 1994 provides that Orders in Council may be made to—
specify the criteria and other requirements by and against which interest rates will be set or reset and notified for the purposes of Part 7 of that Act. These regulations are made under that provision:
set the Commissioner’s paying rate and taxpayer’s paying rate. The actual rates are specified in the Taxation (Use of Money Interest Rates) Regulations 1998.

1 General
This is a consolidation of the Taxation (Use of Money Interest Rates Setting Process) Amendment Regulations 2009 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
Section 78 of the Legislation Act 2019 provides that this consolidation, published as an electronic version, is an official version. A printed version of legislation that is produced directly from this official electronic version is also an official version.
