Pursuant to sections 56 and 57(3) of the Customs and Excise Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, and considering that the prohibition extended by this order is necessary in the public interest, makes the following order.

Order

1 Title

This order is the Customs Export Prohibition (Toothfish) Amendment Order 2012.

2 Commencement

This order comes into force on 10 May 2012.

Order: confirmed, on 12 December 2012, by section 9(d) of the Subordinate Legislation (Confirmation and Validation) Act 2012 (2012 No 97).

3 Principal order

This order amends the Customs Export Prohibition (Toothfish) Order 2009 (the principal order).

4 Clause 3 amended (Expiry)

In clause 3, replace “10 May 2012” with “10 May 2015”.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 10 May 2012, amends the Customs Export Prohibition (Toothfish) Order 2009 so that it expires on the close of 10 May 2015. The effect of this order is to extend for a further 3 years the prohibition on the exportation of Antarctic toothfish and Patagonian toothfish.

Under section 56(5)⁠(a) of the Customs and Excise Act 1996, this order expires on the close of 31 December 2012 except so far as it is expressly confirmed by Act of Parliament passed before that date. If confirmed in that way, this order expires on the close of 10 May 2015.
