Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

The order brings into force, on 18 May 2009, the Protection of Personal and Property Rights Amendment Act 2008 (the amendment Act).

The amendment Act amends the Protection of Personal and Property Rights Act 1988 (the principal Act) to—

• enable the Registrar of the Court to appoint a barrister or solicitor to represent a person in respect of whom an application is made, or to assist the Court; and

• enable the Court to direct the Registrar to request the preparation of a medical, psychiatric, psychological, or other report on the person in respect of whom the application is made; and

• permit accredited news media reporters and support persons to be present at the hearing of any proceedings under the principal Act; and

• provide that sections 11B to 11D of the Family Courts Act 1980 apply to the publication of a report of any proceedings under the principal Act in any court.
