Pursuant to section 16B(1) of the Family Courts Act 1980 and section 187 of the Family Proceedings Act 1980, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
Regulations
1 Title
These regulations are the Family Courts Fees Amendment Regulations 2011.
2 Commencement
These regulations come into force on 1 July 2011.
3 Principal regulations amended
These regulations amend the Family Courts Fees Regulations 2009.

Fees payable in respect of applications under Family Proceedings Act 1980r 5(1)

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 July 2011, amend the Family Courts Fees Regulations 2009. The amendments increase the fees payable for filing applications under sections 27, 29, 32, and 37 of the Family Proceedings Act 1980. The changes reflect the movement in the Consumers Price Index (All Groups) since the date when the fees were last set.
The fees replaced are inclusive of goods and services tax (GST), but were not amended directly to reflect the 1 October 2010 GST increase, and so differed from those actually charged. The new fees are also GST inclusive.
