Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the day after the date of their notification in the Gazette, define remuneration for the purposes of subpart 3 (sections 103 to 107) of Part 2 of the Local Government (Auckland Transitional Provisions) Act 2010 as meaning salary or wages. Subpart 3 of Part 2 provides for redundancy and other compensation for employees of an existing employer in certain circumstances where their existing position will cease to exist or their existing employer will cease to exist. These provisions involve a comparison of an employee's existing remuneration with the remuneration offered for a position that is not the same or not substantially similar to the existing position.

By virtue of section 5(3) of the Act, these regulations will expire on 31 October 2013 unless they are revoked sooner.
